SHOULD GAYS BE ALLOWED TO SERVE IN THE MILITARY? DO THEY HAVE A RIGHT TO SERVE?

Should gays be allowed to serve in the military? Does it go against their constitutional rights? How would you feel if you were denied access into something due to your sexuality?

Reports are flowing in that, U.S. District Judge Virginia Phillips said she is "leaning toward denying a government request to delay her order halting the military from enforcing its ban on openly gay troops.

Is it right that the military does not want gays in the army?  The government has always denied open gays the right to serve and are now in a federal court to ban the entire notion. Now please note, there are some gays in the army the only problem is they are not open. If they were to become open about their sexuality anything could happen and of course troops that are serving now, are faced with the delimnea of should I speak up or shouldn't I?
The judge has stated,  that  banning openly gay troops to serve violates due process rights, freedom of speech and the right to petition the government for redress of grievances guaranteed by the First Amendment. 

If she rejects the request, Justice Department officials say the Obama administration would appeal. Experts say they will likely find friendlier venues in the U.S. Court of Appeals for the 9th Circuit in San Francisco and, ultimately, the U.S. Supreme Court.

Defense Secretary Robert Gates warned of "enormous consequences" for troops if the court order is allowed to stand, saying the decision on repeal of the law known as "don't ask, don't tell" should be decided by Congress and not the courts.
